How predictive are survey results? |
|
This is truly a “frequently asked question” but any answer based on statistics is inherently misleading because so many cases settle and if they don’t, an actual trial will always be quite different from any kind of simulation. The best way to think about an EarlyJury survey is that it is a research tool, designed to give you critical feedback at a critical juncture of your case. Surveys or mock trials aren’t capable of predicting the future. However, when done correctly with well-balanced case presentations that don’t sugarcoat the facts and participants who are properly screened for disqualifying biases - attitudinal surveys will always reveal fascinating and useful information about your case. |

The Benefits of Pre-Trial Research |
|
“Early” defined: Lawyers often consider jury research as a last step, after they’ve spent hundreds of hours and thousands of dollars on a case. At that point, with everything at stake, they realize the need for objective feedback. "Early” means finding out the truth sooner, before litigation costs soar, discovery closes, and clients’ expectations are cemented. “Early” means using research as leverage. Instead of putting all your faith in a trial where the judge and six idiosyncratic jurors have all the power, “Early” means you have the power: To map out the best possible case, to bargain hard for early and advantageous settlement opportunities, and if the time comes, to present an air-tight case that resonates with what real people see and believe. An EarlyJury survey is a cost-effective way to quickly understand how real jurors will view your case. Each EarlyJury report provides a wealth of analysis regarding the jurors’ personal opinions and reactions to each party’s case position. Not only will you understand, in an organized and empirical way, what real lay persons think, but you will be armed with information: Whether you are deciding to take an important case, need leverage for mediation, or are mapping out strategies for depositions, trial and jury selection, this is the kind of feedback you need sooner, not later. Want to get your opponent to take you seriously during an early mediation? Show them what real people think about your case with an EarlyJury report. - Provide your client with a realistic evaluation that allows for effective risk management
- No more posturing: Persuade your opposition with empirical evidence
- Determine case value from the most convincing source: real people.
- Discover which facts matter most to jurors: Find out early what will sell...and what won't.
- Use survey results to identify the characteristics of best and worst jurors.

Can Surveys Be Confidential? |
|
Confidentiality is and should be a concern during all phases of most litigation. There are several ways to help ensure confidentiality.
Contracts – Our EarlyJury survey contract is between a bar-admitted “legal consultant” and the attorney/law firm of record for the case. This provides clear proof that the work we develop for you is privileged and confidential attorney work product.
Juror Recruitment - Ask your potential business partners, “Who will be doing the juror recruitment and what are the criteria by which they judge “security risks?”
- Are the juror recruiters legally trained or working under the direct supervision of a lawyer? Or are the recruiters just telemarketers or staff from a third party vendor?
- Have the recruiters themselves signed confidentiality agreements? The majority of trial consulting firms use third party market research firms - companies that employ cadres of hourly employees with high turnover! If the recruiting is done online, is the technical staff covered by confidentiality agreements?
- Will the person recruiting jurors know the “ins and outs” of your case? Will they know the types of jurors who’d be disqualified in a real courtroom? Have they devised screening questions that uncover disqualifying biases while still protecting information that is highly confidential or otherwise sensitive? Will they know how to, and be willing to probe in the ways necessary to protect confidentiality and eliminate jurors who - for whatever reason – aren’t trustworthy or representative of what is found in a real courtroom?
Before you give your case over to anonymous “jurors” about whom you know nothing, get the answers to these important questions. At EarlyJury, we don’t let the dregs of the Internet get their hands on your case. Our lead trial consultant is a bar-admitted attorney who has years of jury selection experience in real courtrooms all over the country. This experience is the key to giving you a quality work product. |

Attitude Survey Advantages |
|
EarlyJury Surveys are cost-effective because they quickly and accurately give litigants a reality-check about their case. It is the only tool that gives litigants the ability to flag genuine problems before they mushroom into fatal flaws during discovery. Finally, if litigants belatedly realize the need for objective feedback on the eve of trial, surveys can often be done quickly enough to make a profound difference. |
