Can Surveys Be Confidential? |

Confidentiality is and should be a concern during all phases of most litigation. There are several ways to help ensure confidentiality.
Contracts – Our EarlyJury survey contract is between a bar-admitted “legal consultant” and the attorney/law firm of record for the case. This provides clear proof that the work we develop for you is privileged and confidential attorney work product.
Juror Recruitment - Ask your potential business partners, “Who will be doing the juror recruitment and what are the criteria by which they judge “security risks?”
- Are the juror recruiters legally trained or working under the direct supervision of a lawyer? Or are the recruiters just telemarketers or staff from a third party vendor?
- Have the recruiters themselves signed confidentiality agreements? The majority of trial consulting firms use third party market research firms - companies that employ cadres of hourly employees with high turnover! If the recruiting is done online, is the technical staff covered by confidentiality agreements?
- Will the person recruiting jurors know the “ins and outs” of your case? Will they know the types of jurors who’d be disqualified in a real courtroom? Have they devised screening questions that uncover disqualifying biases while still protecting information that is highly confidential or otherwise sensitive? Will they know how to, and be willing to probe in the ways necessary to protect confidentiality and eliminate jurors who - for whatever reason – aren’t trustworthy or representative of what is found in a real courtroom?
Before you give your case over to anonymous “jurors” about whom you know nothing, get the answers to these important questions.
